Terms and Conditions for SeniorScreens

These Terms and Conditions (“Terms”) govern access to and use of the SeniorScreens platform and related services. SeniorScreens is a product of PageGravy, Inc. By using SeniorScreens, you agree to these Terms.

SeniorScreens is designed to help senior living communities share daily facility information, including menus, activities, announcements, reminders, weather, and general news. That information may be displayed on resident-facing devices, personal screens, dashboards, and, where enabled, TVs located throughout the facility.

2. Acceptance of Terms

By accessing, subscribing to, logging into, or using SeniorScreens, you confirm that you are authorized to act on behalf of your facility, business, or organization, and that you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the platform.

3. Description of the Service

SeniorScreens is a communication platform for senior living communities. It allows authorized staff to enter daily facility information into the administrative area so that approved content may be displayed to residents and others through supported viewing formats.

Depending on the services selected by the facility, content may appear on:

resident-facing dashboards
tablets
desktop or browser-based screens
personal devices
TVs throughout the facility

The platform is intended for general facility communication and engagement. Features and functionality may change over time as PageGravy, Inc. updates or improves the service.

4. Authorized Use

SeniorScreens is intended for lawful business use by senior living communities, related facilities, and their authorized personnel. You agree to use the platform only for legitimate communication, scheduling, informational display, and related operational purposes.

You may not use SeniorScreens:

for unlawful, harmful, fraudulent, or misleading purposes
to post defamatory, abusive, or infringing content
to upload viruses, malicious code, or harmful material
to interfere with the operation or security of the platform
to attempt unauthorized access to the system, accounts, or infrastructure

5. Admin Content, Resident Display, and Facility TVs

SeniorScreens is designed so that authorized staff enter content in the administrative area and that content may then be displayed on resident-facing screens, dashboards, devices, and TVs throughout the facility, depending on the services enabled by the facility.

Because of that, you understand and agree that:

content entered into the admin area may appear on resident-facing screens or views
content entered into the admin area may also appear on facility TVs
your facility is responsible for reviewing content before publishing it
your facility is responsible for deciding who has access to the admin area
only information appropriate for the intended audience and display type should be entered into the system

6. No Resident Personal Information Requirement

SeniorScreens is intended for community and facility information, not for storing or displaying sensitive resident records.

Your organization agrees that SeniorScreens will not be used as a medical record system, financial record system, emergency clinical charting system, or other repository for highly sensitive personal information unless separately approved in writing by PageGravy, Inc.

In addition:

SeniorScreens does not require resident personal information in order to operate
facilities should not enter confidential or sensitive resident information into content intended for general display
no personal resident information is intended to appear on facility TVs
if a facility uses SeniorScreens content on TVs throughout the building, that TV content should be limited to general facility-wide information appropriate for public or semi-public viewing

Examples of appropriate TV content may include:

daily menus
activity schedules
community announcements
weather
general news
reminders intended for a broad audience

7. Facility Responsibility for Content

You are solely responsible for all text, notices, menus, activities, reminders, announcements, and other materials submitted through your account or administrative access.

You represent and warrant that:

you have the right to submit and display the content you enter
your content does not violate any law, contract, privacy right, intellectual property right, or other third-party right
your content is appropriate for display to the intended audience
any content displayed on facility TVs is suitable for broad viewing within the facility and does not contain private resident information

PageGravy, Inc. is not responsible for errors, omissions, or consequences arising from content entered by your organization.

8. Account Access and Security

Your organization is responsible for keeping account credentials secure and limiting access to authorized staff only.

You agree to notify PageGravy, Inc. promptly if you suspect:

unauthorized access
compromised login credentials
misuse of the system
a suspected security issue affecting your account

9. Privacy and Data Handling

SeniorScreens is intended to support facility communications while limiting unnecessary handling of resident information. Content entered by facility staff is controlled by the facility.

Because some content may appear on resident devices, shared screens, or TVs throughout the facility, the facility is responsible for ensuring that displayed information is appropriate for the selected display method.

SeniorScreens is not intended for the public display of private or protected resident information. In particular, facility TV displays should contain only general information suitable for shared viewing.

Your use of SeniorScreens is also subject to the applicable Privacy Policy.

10. Third-Party Content and Services

SeniorScreens may display general information such as weather and news. PageGravy, Inc. is not responsible for interruptions, inaccuracies, delays, or changes in any third-party content, feeds, processors, internet services, or linked external services.

11. Fees and Monthly Billing

If your organization subscribes to a paid SeniorScreens plan, you agree to pay the fees associated with that plan.

Unless otherwise agreed in writing:

SeniorScreens services are billed on a recurring monthly basis
monthly fees are charged to the credit card or other approved payment method on file
you authorize PageGravy, Inc. and its third-party payment processor to charge the applicable recurring fees
charges may continue each month until the service is canceled in accordance with these Terms

If a payment is declined, fails, or cannot be completed, PageGravy may suspend or limit access until the account is brought current.

12. Payment Processing

Credit-card payments may be processed through a third-party payment processor on behalf of PageGravy, Inc. By submitting payment information, you authorize the processing of recurring monthly charges for your SeniorScreens subscription.

Payment processing may also be subject to the terms and privacy policies of the third-party processor used for billing.

13. Late or Failed Payments

If a recurring charge fails, PageGravy, Inc. may:

retry the payment method on file
contact your organization for updated billing information
suspend access to all or part of the service
terminate service for nonpayment if the account remains delinquent

Your organization remains responsible for all unpaid charges incurred before cancellation or termination.

14. Cancellation and Termination

Either party may terminate service subject to any separate written service agreement between the parties.

If no separate written agreement states otherwise:

your organization may request cancellation by contacting PageGravy, Inc.
cancellation will stop future recurring billing after the effective cancellation date
previously billed amounts are nonrefundable unless required by law or agreed in writing
PageGravy may terminate or suspend service for nonpayment, misuse, security concerns, unlawful activity, or material violation of these Terms

15. Availability and Support

SeniorScreens is provided on an “as available” basis. PageGravy, Inc. does not guarantee uninterrupted availability, error-free performance, or that every issue will be corrected within a specific time unless separately agreed in writing.

16. Intellectual Property

SeniorScreens, including its software, design, layout, branding, graphics, interface elements, and related materials, is owned by or licensed to PageGravy, Inc.

Except for your own submitted content, no part of the service may be copied, resold, distributed, reverse engineered, or exploited without prior written permission from PageGravy, Inc.

17. Disclaimer of Warranties

To the fullest extent permitted by law, SeniorScreens is provided “as is” and “as available,” without warranties of any kind, whether express or implied.

PageGravy, Inc. does not guarantee that:

the service will always be uninterrupted or error-free
the platform will meet every facility’s specific regulatory or operational requirements
third-party content, such as weather or news, will always be current or accurate
user-entered content will be free from mistakes

18. Limitation of Liability

To the fullest extent permitted by law, PageGravy, Inc. and its owners, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or use arising out of or related to SeniorScreens.

PageGravy, Inc.’s total liability for any claim relating to SeniorScreens will not exceed the amount paid by your organization for the service during the three months preceding the event giving rise to the claim, unless a different limit is required by law or separately agreed in writing.

19. Indemnification

You agree to defend, indemnify, and hold harmless PageGravy, Inc. and its affiliates, officers, employees, and contractors from and against claims, liabilities, damages, losses, and expenses arising out of:

your use of the platform
your organization’s content
your violation of these Terms
your violation of any law or third-party rights
unauthorized or improper use of your account by your staff or agents

20. Changes to the Service or Terms

PageGravy, Inc. may update SeniorScreens or these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated.

Continued use of the service after revised Terms are posted constitutes acceptance of the updated Terms.

21. Governing Law

These Terms will be governed by the laws of the State of Ohio, without regard to conflict-of-law principles, unless a separate written agreement states otherwise.
